1. Introduction

Nurserybala is a multi-vendor marketplace that facilitates the sale of wholesale and retail plant nursery products. These Terms govern the use of the Platform, including all transactions between vendors and customers.

2. Eligibility

By using the Platform, you represent that you are at least 18 years old and capable of entering into legally binding agreements. If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

3. Registration and Account

  • Vendors must provide accurate, up-to-date, and complete information during the registration process. Vendors are also responsible for maintaining and updating their listings.

4. Vendor Obligations

  • Vendors are required to comply with all applicable laws and regulations related to the sale of plants and nursery products.
  • Vendors must ensure that all products listed on the Platform are accurately described, including the condition, type, and quality of the plants.
  • Nurserybala is not liable for any misrepresentation by vendors.

5. Purchasing and Payments

  • Customers can browse, select, and purchase products from vendors listed on the Platform. Payment methods accepted on Nurserybala will be indicated at the checkout.
  • Prices of products may vary depending on the vendor and product category.
  • Nurserybala reserves the right to cancel or refuse any order at its discretion, including for reasons such as product unavailability or incorrect pricing.

6. Shipping and Delivery

  • Shipping policies, charges, and delivery times may vary between vendors. Each vendor is responsible for fulfilling their respective orders.
  • Customers will be provided with estimated delivery times and shipping details upon placing an order. Nurserybala is not responsible for delays caused by third-party logistics services.

7. Returns and Refunds

  • Vendors may have their own return and refund policies. Customers are advised to review the vendor’s policies before making a purchase.
  • Nurserybala may facilitate the return or refund process, but is not responsible for any disputes between customers and vendors.

8. Vendor Commission and Fees

  • Nurserybala charges vendors a commission fee for using the Platform. The exact percentage of commission will be provided to vendors upon registration.
  • Vendors are responsible for paying any fees or charges associated with the use of the Platform.

9. Prohibited Activities

  • Users and vendors may not use the Platform for illegal activities, fraudulent practices, or actions that infringe upon the rights of others.
  • Nurserybala reserves the right to terminate any user or vendor account if found in violation of these Terms.

10. Intellectual Property

All content available on the Platform, including logos, text, graphics, images, and software, is the property of Nurserybala or its licensors. Unauthorized use of any intellectual property may result in legal action.

11. Limitation of Liability

Nurserybala is a marketplace facilitator and is not directly involved in the transaction between customers and vendors. We are not liable for any damages, losses, or disputes arising from the purchase of products on the Platform.

12. Indemnification

You agree to indemnify and hold Nurserybala harmless from any claims, liabilities, damages, or expenses arising from your use of the Platform or violation of these Terms.

13. Termination

Nurserybala reserves the right to suspend or terminate your access to the Platform at any time, with or without cause or notice.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Odisha, India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Bhubaneswar, Odisha.

Nurserybala reserves the right to modify or update these Terms at any time. Any changes will be posted on the Platform, and continued use of the Platform constitutes acceptance of the revised Terms.
